Terms and Conditions of Trading
1. SUPPLY AND RETURN OF GOODS
(a) All Goods returned must be undamaged, complete, and in original packing.
We cannot accept returns of opened or part-used Goods.
We recommend trying a tester pot to ensure you're happy with the final colour of any paint purchased.
If you have an issue with any of the products, please contact us.
(b) Returns on non-faulty and unopened Goods subject to a restocking charge at 3P Technik UK Limited’s discretion, up to a maximum of 30%
(c) Free samples are not supplied.
(d) Goods are not supplied on a trial basis.
2. DELIVERY
(a) Any delivery period is an estimate only and commences from 3P Technik UK Limited's acknowledgement of the Purchaser's order.
(b) 3P Technik UK Limited shall be under no liability for delay or failure in delivery.
(c) In the event of a stock shortage 3P Technik UK Limited may deliver the Purchaser’s order in multiple consignments.
3. WARRANTY
(a) All New Goods carry a 1 year RTB (Return To Base) warranty unless otherwise stated in writing, commencing from the date of issue of Invoice by 3P Technik UK Limited.
(b) All Second Hand Goods carry no warranty unless otherwise stated in writing.
(c) All Reconditioned Goods carry no warranty unless otherwise stated in writing.
(d) In accordance with Condition 3(a), 3P Technik UK Limited guarantees to replace, refund the price of, or repair, at 3P Technik UK Limited's discretion, any New Goods supplied by 3P Technik UK Limited, and found to 3P Technik UK Limited's satisfaction to be defective within 12 months of the date of issue of the Invoice for aforementioned Goods by 3P Technik UK Limited, excepting products which are excluded from warranty by Condition 3(b), 3(c), or 3(e).
(e) Goods supplied by 3P Technik UK Limited which have been subsequently modified or repaired other than by 3P Technik UK Limited, or which have been operated or maintained other than in accordance with the Manufacturer's or 3P Technik UK Limited's recommendations for use shall be excluded from 3P Technik UK Limited's warranty.
(f) In the case of Goods repaired, or replaced by 3P Technik UK Limited, the guarantee period shall continue unchanged from the original date of 3P Technik UK Limited's Invoice.
4. DISTANCE SELLING REGULATIONS
If the Purchaser is buying as a ‘consumer’, as defined in The Consumer Protection (Distance Selling) Regulations 2000, the Purchaser may, provided the Purchaser has taken reasonable care of the Goods, and returns the Goods complete, undamaged, and with their original packaging (including the 3P Technik UK Limited’s outer packaging), return the Goods and be repaid the price paid in respect of them within 7 working days (excluding Saturday and Sunday and any UK Bank Holiday) of their delivery. To return Goods on this basis, the Purchaser must notify the 3P Technik UK Limited in writing and return the Goods, in their original packaging, within the 7 day period to “ 3P Technik UK Limited, Unit 9 Parc Teifi, Cardigan, SA43 1EW“ quoting the order number or invoice number. The Purchaser is responsible for the payment of all postage or carriage costs. The Purchaser is responsible for the care and custody of the Goods pending return or collection. Following receipt of Goods which comply with this Condition 4, 3P Technik UK Limited will refund to the Purchaser the price paid in respect of the Goods.
4. LIMITATIONS OF LIABILITY
(a) 3P Technik UK Limited shall not be liable in contract, tort, breach of statutory duty or otherwise for any loss (consequential or otherwise), injury, destruction or damage arising out of or in connection with the supply of Goods or services by 3P Technik UK Limited.
(b) If for any reason the provisions of Condition 4(a) are of no effect in respect of a claim against 3P Technik UK Limited, 3P Technik UK Limited's liability in respect of that claim shall in no event exceed the price paid for the relevant Goods or services by the Purchaser.
(c) 3P Technik UK Limited shall not be liable for transportation and shipping costs associated with the return of products from either under warranty or otherwise unless the aforementioned return of products is due entirely to 3P Technik UK Limited’s failure to correctly fulfill the Purchaser’s order.
5. QUOTATIONS AND ACCEPTANCE
(a) Quotations represent no obligation to accept the Purchaser's order, and are valid for thirty (30) days, or while stocks last.
(b) Price lists issued by 3P Technik UK Limited do not constitute a formal quotation and are subject to change without notice.
6. TITLE AND RISK
(a) Legal title to the Goods shall remain with 3P Technik UK Limited until such time as 3P Technik UK Limited has received payment for the price of the Goods supplied by 3P Technik UK Limited to the Purchaser, whereupon Title shall pass to the Purchaser. Insofar as Goods may be collected by or delivered to the Purchaser prior to the time when Title thereto passes to the Purchaser as aforesaid, the Purchaser shall, until such time hold the Goods as the fudiciary agent and bailee of 3P Technik UK Limited and shall remain liable to account to 3P Technik UK Limited for the Goods, or if the same shall be sold by the Purchaser (which the Purchaser shall be entitled to do as the fudiciary agent of 3P Technik UK Limited) for all the proceeds thereof without limitation.
(b) Notwithstanding the retention by 3P Technik UK Limited of legal title to the Goods (i) Risk in Goods shall pass to the Purchaser upon collection by or delivery to the Purchaser, and (ii) 3P Technik UK Limited shall be entitled to maintain an action against the Purchaser for the price of the Goods or any part thereof.
7. LIEN
3P Technik UK Limited shall have a general lien in respect of all sums due from the Purchaser upon all Goods upon which work has been done on the Purchaser's behalf.
8. LAW
(a) This agreement shall be governed by the laws of England and Wales.
9. DEFINITIONS
(a) The Purchaser means the individual or company with whom the sale or supply of products or services is conducted.
(b) Invoice means the source document of Sale provided by 3P Technik UK Limited to the Purchaser, listing the Goods supplied and price charged by 3P Technik UK Limited.
(c) New Goods does not include Second Hand products, reconditioned products, or products containing second hand parts.
(d) Second Hand Goods means products or parts that have been previously purchased by a consumer, or purchased other than as stock for re-sale.
(e) Reconditioned Goods means products or parts that have been repaired or re-assembled by either (i) The Manufacturer, or (ii) 3P Technik UK Limited, subsequent to the original time of manufacture or assembly.
10. ACCEPTANCE OF TERMS
(a) All Goods and services supplied are deemed subject to sale in accordance with the above conditions, unless otherwise stated in writing.
(b) 3P Technik UK Limited's terms and conditions shall apply to the entire exclusion of those of the Purchaser, and no variation thereof shall be binding unless accepted in writing by 3P Technik UK Limited.
